By creating an account or using Gratitude, you agree to these terms. Please read them carefully. If you do not agree, do not use the app.

1. Acceptance of terms

These Terms of Service ("Terms") govern your use of the Gratitude app ("App"), operated by Gratitude Journal ("we", "us", or "our"). By creating an account, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are under 13 years of age, you may not use the App. If you are between 13 and 18, you may only use the App with the consent of a parent or legal guardian.

2. Your account

To use Gratitude, you must create an account with a valid email address and password. You are responsible for:

3. Your content

You own your journal entries. The text you write or speak in the App belongs to you. We do not claim ownership of your content.

By using the App, you grant us a limited licence to store, process, and display your content solely for the purpose of providing the App's features to you. We do not use your journal entries for any other purpose, including training AI models or advertising.

You are responsible for the content you create. You agree not to use the App to create content that is illegal, harmful, threatening, abusive, or violates the rights of others.

Gratitude offers a free trial period followed by a paid subscription.

6. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any defects will be corrected.

Gratitude is not a medical or mental health service. The App is not a substitute for professional medical advice, diagnosis, or treatment. If you are experiencing a mental health crisis, please contact a qualified healthcare professional or emergency services immediately.

7. Limitation of liability

To the fullest extent permitted by applicable law, Gratitude Journal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising from or related to your use of the App.

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $10, whichever is greater.

You agree to indemnify, defend, and hold harmless Gratitude Journal and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another person or entity.

9. Account deletion and data

You may delete your account at any time from Settings → Danger zone → Delete my account within the App. Upon deletion, all your journal entries and personal data will be permanently removed from our systems within 30 days.

We reserve the right to suspend or terminate your account if you violate these Terms, with or without notice.

10. Intellectual property

The Gratitude app, including its design, features, branding, and content (excluding your journal entries), is owned by Gratitude Journal and protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the App without our prior written permission.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

14. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through the App at least 14 days before the changes take effect. Your continued use of the App after the effective date constitutes your acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the App and delete your account.

15. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Gratitude Journal.
